Development
Funds
It is common knowledge that real estate investments take longer to be traded than investment in securities. The key feature of real estate funds is to transform real estate investments in financial assets (shares) that allow you to generate cash without the need, for the investor, to acquire a property directly.
Real estate funds are only of closed type since the right of the participants to redeem their shares is approved only at predetermined intervals. Therefore, they are characterized by having predefined assets ab origine divided into a predetermined number of shares (the amount initially predefined may vary as a result of normal changes in value related to the appreciation or depreciation of assets that constitute it, and due to changes in the entity, connected to management activities, and possibly as a result of new subscriptions and new repayments at predetermined deadlines, allowed by recent regulatory changes introduced in the field). The shares may be purchased, subject to availability, only during the bidding stage (time-limited) and the repayment is usually only done at maturity, providing the ability to buy them or sell them on a regulated market if there are negotiated. The listing on a regulated market, provided for by law, ensures easy and quick liquidity of invested capital.
Participants can regain possession of the capital invested plus any capital gains, or can be penalized by the market discount, that is the difference that exists between the market price and the asset value of the share indicated in the interim report and annual report. The new Regulation amended civil rules and fiscal policy of the funds; for closed-end funds was introduced the possibility of collecting through further subsequent share issues – albeit within a specified period of time- and, simultaneously, the possibility of early redemption of the shares (“half-closed funds”). Real estate funds can, depending on the terms of the Regulation, distribute or not the operating income.
